01Purpose and scope

These Terms of Use govern access to and use of the website https://www.hex.co.ma and of the demonstrations, prototypes, interactive experiences and test features made available by HEX.

Simply browsing the site means you are informed of these terms. Where a demonstration makes access conditional on accepting them, starting that demonstration constitutes acceptance of the applicable terms.

Some demonstrations reached from the HEX website run at separate addresses or in separate environments. They may be subject to their own terms of use and their own data protection information. Where these differ, the terms and information presented directly within the demonstration concerned apply to its use.

02About HEX

HEX is a phygital experience platform published by UPOUI. It is used to design and deploy brand activations that connect a physical place, its audience and the measurement of the interactions produced.

This website is informational. It is neither a contractual offer nor an online subscription service: any commercial relationship is the subject of a separate written agreement.

03Access to the website

The website is freely accessible. Browsing it requires no account, no registration and no personal information.

You are responsible for your equipment, your connection and the security arrangements needed to access the site, and for the associated costs.

04Access to demonstrations

HEX makes demonstrations available so that selected features and experience formats can be explored. They are reached from this website and open at their own addresses.

Depending on the demonstration, access may be:

• open and immediate;
• conditional on accepting specific terms;
• conditional on providing certain information, as described in section 06;
• time-limited, restricted to a particular audience, or by invitation.

A meeting can also be booked through Calendly, a third-party service operated independently of HEX.

05Nature of the demonstrations

The demonstrations are provided so that users can explore selected features and experience formats available through HEX.

They are evaluation and test environments. As such:

• they may be configured more simply than a deployment delivered for a client;
• they may change, be reset or be withdrawn without notice;
• they do not necessarily reflect every setting, content item or volume of a final deployment.

Each activation delivered for a brand, venue or event is configured specifically, under the agreement reached with the client concerned.

06Information you provide

Depending on the demonstration, you may be invited to provide certain information, for example an email address, a name, an organisation, a role, answers, preferences or text you enter yourself. Not every demonstration asks for this information, and those that do will not ask for all of it.

Where an email address is requested, it may be used to give access to the demonstration, to find or restore a session, to send you the material you asked for, to answer your request, to follow up on a demonstration you specifically requested, and to prevent abuse and security incidents.

Providing an email address in that context does not subscribe you to a newsletter and is not consent to receive commercial communications. Any such sending requires separate consent, given separately and withdrawable at any time.

The information you provide must be accurate and you must be entitled to provide it. If it concerns another person, you must have the authority or the basis needed to pass it on.

07Demonstration data

Depending on the demonstration, information may be recorded where it is needed to run the demonstration, remember progress, calculate a result, diagnose an error, prevent abuse or assess how the demonstration itself performs.

Users must not enter sensitive, confidential, financial or health data, identity documents or authentication credentials into free-text fields, content, missions or features that are not expressly intended for them.

Authentication credentials should only be entered in the dedicated authentication interfaces provided by the experience concerned.

Where identity verification is required as part of a specific process, including for the awarding of a prize, information concerning the processing of personal data applicable to that verification must be provided as part of the relevant process.

Nor should the demonstrations be used to store or process data that is critical or needed for a production activity. They are neither a storage space nor a production environment, and their contents may be reset.

The processing of personal data is governed by our Privacy Policy and, where a demonstration is operated under its own data notice, by that notice.

08Permitted use

The site and the demonstrations may be used for information, evaluation and testing, including in a professional context, to assess a possible project with HEX.

You may read the content, link to it, and save or print it for your own internal evaluation.

09Prohibited use

The following are prohibited:

• any attempt to gain unauthorised access to the site, the demonstrations or their systems;
• circumventing or defeating security measures;
• accessing, or attempting to access, another user’s session or data;
• anything liable to disrupt the availability of the service, including placing an abnormal load on it;
• automated use, systematic extraction or scraping of content beyond ordinary search-engine indexing;
• decompilation or reverse engineering, other than as the applicable law expressly permits;
• introducing malicious code;
• impersonation, or misrepresenting a relationship with HEX;
• submitting unlawful or harmful material, or material infringing the rights of others;
• any use contrary to the law or to these terms.

If you believe you have found a security issue, please tell us at contact@upoui.com rather than testing it further.

10Intellectual property

The HEX software, the demonstrations, the interfaces, the visual design, the content, the artwork, the names and distinctive signs, and the underlying technology and code, are protected by the applicable intellectual property rights and belong to UPOUI or its licensors.

Nothing in these terms transfers ownership to you or grants you a licence beyond the use described in section 08. The HEX and UPOUI names and logos may not be used without written permission, except to refer to us factually and accurately.

Some demonstrations include elements belonging to the clients, partners or venues they were built for. Those elements are shown by way of illustration and may not be extracted, reproduced, redistributed or adapted.

11Content you submit

Where a demonstration lets you enter text or submit content, you keep your rights in that content.

You grant us only the permission necessary to store, process and display it within the demonstration in order to deliver the function you asked for, and to keep the technical records needed for the security of the service. That permission is not an assignment and allows us no commercial exploitation of your content.

12Availability and change

The site and the demonstrations are provided on an “as is” and “as available” basis. They may be changed, suspended, reset or withdrawn, in whole or in part, without notice. As demonstration environments, they carry no guarantee of availability, continuity or retention of content.

13Demonstration results and content

Some demonstrations produce results: scores, rankings, recommendations, dashboards or indicators. The figures shown on this website by way of illustration are examples, intended to show the kind of measurement the HEX engine produces.

Those results are provided for demonstration and evaluation. They are not professional advice, not a performance guarantee, not a contractual commitment and not production reporting. Real results depend on the brief, the location, the audience and the campaign, and are agreed case by case.

14Third-party services and links

The site and the demonstrations link to services we do not operate, in particular Calendly, LinkedIn and the UPOUI website. Those links are provided for convenience and are not an endorsement. Once you follow them, the terms and privacy policy of the service concerned apply, and we are not responsible for their content, their availability or their practices.

15Data protection

The processing of personal data carried out in connection with the site and the demonstrations is described in our Privacy Policy, which sets out the data concerned, the purposes, the recipients, the retention periods and your rights under Law No. 09-08.

Cookies and similar technologies, and your choices regarding audience measurement and advertising, are described there as well. You can change or withdraw your consent at any time from “Manage cookies” at the foot of the page.

UPOUI implements technical and organisational measures intended to protect the site, the demonstrations and the information processed. As no arrangement can guarantee absolute security, please do not send sensitive or confidential information through this channel.

16Liability

The site and the demonstrations are made available for presentation and evaluation, and may contain illustrative content and figures. To the extent permitted by law, we exclude implied warranties concerning the site, the demonstrations and their content, in particular as to accuracy, completeness or fitness for a particular purpose.

To the extent permitted by law, we are not liable for indirect loss, or for loss of profit, revenue, business, goodwill, data or anticipated savings, arising from the use of, or inability to use, the site or the demonstrations.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including for personal injury caused by negligence, or for fraud or fraudulent misrepresentation.

17Suspension or termination of access

We may suspend or end your access to the site or to a demonstration, without notice, if these terms are breached, if your use is liable to affect the security or availability of the service, or when the demonstration concerned comes to an end. You may stop using the site and the demonstrations at any time.

18Changes to these terms

These terms may be amended to reflect changes to the site, to the demonstrations or to the applicable rules. The version in force is the one published on this page, and the date at the top of the document shows when it was last updated. Using the site after a change is published means you accept it.
